Просимо вас звернути особливу увагу на пункт 1.15 тендерної документації (зміни до тендерної документації) щодо реєстрації в Тематичному каталозі учасників процедур закупівель (далі - каталог), що видає Тендерна палата України.
Вимога щодо реєстрації в каталозі є обов’язковою для всіх учасників процедур закупівель, у тому числі для нерезидентів України. Це передбачено абзацами 4-7 пункту 10 статті 17-3 Закону України "Про закупівлю товарів, робіт і послуг за державні кошти", де визначено наступне:
- З метою вивчення ринку продукції та сприяння створенню конкурентного середовища у сфері державних закупівель Тендерна палата України видає тематичний каталог учасників процедур закупівель із загальнодержавною сферою розповсюдження, в якому публікується, у тому числі, інформація щодо учасників, ринків та цін товарів, робіт і послуг у сфері державних закупівель, інша інформація щодо здійснення державних закупівель. Каталог видається у друкованому та електронному вигляді.
- До каталогу включаються фізичні та юридичні особи на підставі їх звернення. У зверненні зазначаються такі відомості:
повне найменування;
юридична та фактична адреса;
прізвище, ім’я, по батькові керівника;
телефон;
ідентифікаційний код за Єдиним державним реєстром підприємств та організацій України (для юридичних осіб) або прізвище, ім’я, по батькові, місце проживання, телефон, ідентифікаційний номер за Державним реєстром фізичних осіб - платників податків та інших обов’язкових платежів (для фізичних осіб);
свідоцтво про державну реєстрацію;
дозвіл та/або ліцензія на провадження відповідної діяльності у випадках, передбачених законодавством;
інші документи, що підтверджують реєстрацію (для нерезидентів);
досвід (за винятком новостворених суб’єктів);
види товарів, робіт чи послуг, які поставляє (виконує) фізична чи юридична особа;
інша інформація.
Відповідальність за достовірність інформації несе особа, що звертається.
- Інформація про фізичну чи юридичну особу включається до каталогу протягом п’яти робочих днів з дати надходження звернення. Тендерна палата України має право звернутися до контролюючих, правоохоронних та інших державних органів для перевірки інформації, зазначеної у зверненні. У такому разі строк включення інформації про фізичну чи юридичну особу до каталогу подовжується до 30 робочих днів. Виявлення фактів надання фізичною чи юридичною особою будь-якої недостовірної інформації є підставою для невключення інформації до каталогу. Рішення про відмову у включенні до каталогу може бути оскаржене фізичною чи юридичною особою до Комісії з питань державних закупівель України або до суду. Інформація, зазначена в каталозі, оновлюється щорічно. Інформація про фізичну чи юридичну особу включається до каталогу строком на один рік, із завершенням якого підлягає оновленню.
- Інформація, зазначена в каталозі, використовується замовником в порядку, визначеному цим Законом, під час організації та проведення процедур закупівель.
Просимо звернути увагу, що процедура реєстрації в зазначеному каталозі здійснюється виключно українською мовою. Форма заявки на включення до Тематичного каталогу учасників процедур закупівель додається до тендерної документації (у тому числі з перекладом основного змісту форми заявки для осіб, які виявила бажання взяти участь в торгах, але не є резидентами України).

Dear Sirs,
The Ministry of Justice of Ukraine would like to draw your attention to the point 1.15 of the Tender documentation (Changes to the tender documentation) concerning the Registration in the Subject directiry of purchase proceedures’ participants (hereinafter – the Catalogue) carried by the Tender Chamber of Ukraine.
Requirement concerning the registration in the Catalogue is obligatory for all the participants of purchase proceedures including non-residents of Ukraine. It is provided in paragraphs 4-7 of point 10 of the Article 17-3 of the Law of Ukraine "On Purchase of Commodities, Works and Services for the State Funds", where the following is provided:
With the purpose of study of market of products and assistance to creation of competition environment in the field of government purchases the Tender chamber of Ukraine gives out the thematic catalogue of participants of procedures of purchases (hereinafter – the Catalogue) with the national sphere of distribution, in which is published, including, information on participants, markets and costs of commodities, works and services in the field of government purchases, information foreseen by the articles 16, 16 1, other information on realization of government purchases. The Catalogue is given out in a printing and electronic kind.
Physical and legal persons on the basis of their request are included in the Catalogue. In the request the following information should be given:
complete name;
legal and actual address,
last name, name, patronymic leader,
telephone,
identification code after the Unique state register of enterprises and organizations of Ukraine (for legal entities) or the last name, name, patronymic, place of residence, telephone, identification number after the State register of physical persons - payers of taxes and other obligatory payments (for physical persons);
certificate about state registration; permission and/or license to realization of the proper activity in cases foreseen by the legislation;
other documents which confirm registration (for non-residents);
experience (except for the accrued subjects);
types of commodities, works or services which a physical or legal person supplies (executes) with;
other information.
Responsibility for authenticity of information is carried by a person, that applies.
Information about a physical or legal person joins in a catalogue during five working days from the date of receipt of appeal. The tender chamber of Ukraine has a right to appeal to the supervisory, law-enforcement et al state organs for verification of the information marked in circulation. At that rate the term of including of information about a physical or legal person to the catalogue is prolonged to 30 working days. The exposure of facts of grant by the physical or legal person of some unreliable information is foundation for unincluding of information to the catalogue. The decision about the refusal in including to the catalogue can be appealed by a physical or legal person to Commission or to the court. The information marked in a catalogue brushes up annually. Information about a physical or legal person joins in a catalogue for a term of one year, with completion of which is subject to the update.
The information marked in a catalogue is used by a customer in an order certained by this Law, during organization and conducting of procedures of purchases.
Please note that the proceedure of registration in the above Catalogue is exercised only on Ukrainian. The form of the Request for including to the Subject is attached to the tender documentation (including translation of the basic provisions of the form for those persons who would like to participate in the tender, but those who are non-residents of Ukraine).
